Perhaps not for a simple curve, but the tables in ECUs are generated
from extended testing of the engine and are not simple curves.

It is irrelevant what the bits represent, be it code or data.
It's still covered by copyright.  For example, there is no such
thing as a data table on a PIC, it's all code, but there is a
method of using a code sequence for a data table.  You can't
make this code/data table distinction.
